By using the Happervilla website, you affirm that you are at least 18 years old, that any registration information you provide to Happervilla is true, accurate, and complete, and that you agree to the Terms and Conditions of this Agreement as well as the Happervilla Privacy Policy.

Please carefully read the following terms and conditions. These terms and conditions govern your access to and use of the Happervilla website (the "Site"), as well as any material, information, goods, and/or services (the "Services") made available on the Site. This is a legally binding contract between you and Happervilla ("Company"). Company reserves the exclusive right, at any time and without notice, to modify, cease, or terminate the Site and Services, or to amend the Terms of Service. All amended terms and/or conditions will take effect after they are posted on the Site (unless applicable law requires a longer notice period). You agree to be legally bound by the updated Terms of Service by continuing to use or access the Site and/or Services after the Company makes any such adjustment. You may not change the terms and conditions of the Terms of Service without the express written approval of the Company.

YOU AGREE TO BE BOUND BY THE TERMS OF SERVICE BY USING THE SERVICES OFFERED BY THE COMPANY THROUGH THE SITE. YOU MAY NOT ACCESS OR USE THE COMPANY'S SERVICES IF YOU DO NOT ACCEPT THESE TERMS OF SERVICE IN THEIR ENTIRETY.

NOTICE OF COPYRIGHT

All of Happervilla's home plans are protected by International Copyright Law. Without prior written authorization, reproduction of these home plans, in whole or in part, including any form of copying and/or development of derivative works thereof, is strictly forbidden and subject to statutory damages plus legal fees and loss of profits. If a copyright is breached, all parties, including designers, draftsmen, owners, builders, realtors, copy shops, and blue-prints, may be held liable. It makes no difference whether they were aware that what they were doing was illegal.

Harmony Group Limited maintains the right to publish, sell, resell, market, or utilize any design, custom design, drawing, detail, picture, calculation, sketch, or other material generated by Harmony Group Limited in any way. Unless otherwise agreed in writing between Harmony Group Limited and the customer, the foregoing remains the express property of Harmony Group Limited at all times.

UNIQUE DESIGNS

If you cannot find a plan that meets your demands, Harmony Group Limited will build new bespoke plans based on your specific needs. You will receive regular updates on plans and elevations to provide you with an accurate picture of how the plans will work and how the building will appear. During the drawing stage of drafting the blueprints, changes can be requested up to four times. Any extra modifications made after this, or after the client's final acceptance of the sketch design, will be charged at a rate of USD 25 per hour.

Please keep in mind that the copyright rules (under the heading COPYRIGHT NOTICE) apply to custom-designed plans as well. Please contact us if you would want to purchase exclusive rights to the design and plans.

POLICY ON PRIVACY

Happervilla values and respects its customers' privacy.

We gather customer information to deliver our items to you, as well as to improve your shopping experience and communicate with you about our products, services, and promotions. Happervilla understands the importance of protecting and appropriately using consumer information. We never sell or rent the information you provide us online to third parties.

PRICING

Prices are subject to change at any time without notice. We may occasionally uncover data entry problems in the pricing of our plans due to the wide plan selection and different price alternatives offered on Happervilla.com. Happervilla retains the right to fix any inaccuracies identified. No order or pricing is official unless Happervilla confirms it.

REFUND / EXCHANGE POLICY AT HAPPERVILLA:

A download link or file attachment will be sent once the transaction has been approved and authorized by our payment gateway and sales personnel. After a payment has been processed, there are no refunds allowed. You may swap a download link or attached file before it is given to you; however, this only applies to equivalent priced plans. Membership in the Premium Account is non-refundable. Once the schematic design process has begun, advance fees for bespoke designs are non-refundable.

ELEVATION VIEWS, PHOTOGRAPHS, AND PERSPECTIVES:

All Home Plans include at least one image, perspective, or elevation view to assist you in visualizing the Homes - they are simply intended to be basic guidelines to what the Home may look like when completed.

Please keep in mind that pictures, perspectives, and elevation views may not exactly depict the final building sets due to modifications made throughout the construction or rendering process. Also, keep in mind that not all of the elements displayed in photographs, perspectives, and elevations are necessary included in the final drawings package that you purchase, since some are merely for aesthetic and illustrative purposes.

DO NOT BUILD MORE THAN ONE HOUSE WITH PLANS.

The initial purchaser of a home design is authorized to construct a single home using the blueprints. Building more than one home from the designs without permission is a violation of the home designer's intellectual property. The drawings you receive via email or as printed copies may only be used to build one home; if you need to build more than one home using the same plans, you must purchase one set for each additional home.

WHAT COMES WITH A DRAWING SET?

Because we have a huge collection of drawings from a variety of designers, architects, and engineers, there will inevitably be discrepancies in the kind of drawings included in each drawing set. However, we make every effort to provide all accessible drawings for each Home Plan so that you are fully aware of the contents before purchasing any drawing bundle. If you have any queries or concerns about what is included in the drawing set you want to buy, please contact Happervilla.

Please do not buy any drawings from Happervilla until you are certain of the content of the drawing set you are going to buy. In addition to the drawings provided on the product page, Happervilla will give you with a comprehensive list of drawings upon request. If you have any questions concerning which plans are necessary for the construction of your home, please contact your builder or contractor as well as the local building authority.

We do have a minimum requirement for each drawing set available for purchase on our website, which is as follows:

Floor Plan(s) - Each level's floor plan is fully drawn and dimensioned.
Cross Section(s) - Complete and/or partial cross-section (s)
Elevations for each side of the structure
Where feasible, we provide all perspective drawings and other site graphics.

It should be noted that none of the Home Plans contain site plans. If you want a site plan, please contact us directly with your block plan / topographical survey or site dimensions (including diagonal measures) and we will generate one for you for a modest cost. This will also assist you in visualizing how the plan will appear on your property.
